Terms of use
Terms for the Finegrain camera, web app, SDK and API.
Last updated: 11 October 2026
Use Finegrain to create photographic enhancements and artistic interpretations, or integrate its technology into your app. You retain your rights in your photos and outputs. On-device and cloud services have different processing rules, described below.
1. Scope and provider
These terms govern the Finegrain website, camera app, dashboard, web app, SDK and API provided by Lagon Technologies SAS, 3 Rue Joliot-Curie, 91190 Gif-sur-Yvette, France, registered with the Evry Trade and Companies Registry under number 922 507 405. Contact hello@finegrain.ai.
Use the services only if you have the legal capacity and authority to enter into the applicable agreement. If you act for an organization, you must be authorized to bind it. An individually agreed contract or order prevails over these terms where inconsistent. Mandatory consumer rights remain unaffected. Apple’s applicable terms also govern TestFlight distribution.
2. Accounts, access and trials
Provide accurate account details, protect your credentials and API keys, and notify us promptly of suspected unauthorized access. You are responsible for use under your account to the extent permitted by law. Do not share private keys in public code or allow unauthorized access.
The camera beta is currently free and requires a supported iPhone, iOS version and TestFlight. Developer trials, credits, usage limits and supported features are those presented with the applicable offer. Trial credits have no cash value. A free trial does not itself authorize us to charge you: paid terms must be presented and accepted before purchase.
3. App and web-app use
We grant you a limited, non-exclusive right to use the apps for their intended purposes under these terms. The camera app creates variants on your device and preserves originals. The web app sends photos to the cloud API; it is not an on-device processing service. Review outputs and keep copies you need. The web app and API are not long-term photo-storage services.
Beta features may change, be incomplete or expire. Device compatibility, transforms and service availability may evolve. We do not guarantee a particular photographic result or uninterrupted operation, without limiting rights that apply by law.
4. SDK and API integration
Subject to the applicable plan and these terms, we grant you a limited, non-exclusive license to integrate the SDK into your applications and distribute its runtime components as embedded parts of those applications, and to access the API to deliver transformations through your applications. Distribution must follow our documentation, preserve required notices and protect keys and proprietary components. Your end users may use the integrated functionality; no ownership of Finegrain technology transfers to you or them.
This permission does not authorize standalone redistribution or resale of the SDK, models or API credentials, offering a substitute general-purpose Finegrain API, extracting model weights, circumventing usage limits or reverse engineering except where applicable law permits it. Broader licensing or resale requires a separate written agreement. Third-party components remain subject to their applicable licenses.
You are responsible for your application, its user-facing terms and privacy notices, lawful instructions to Finegrain and any permissions needed to process users’ content. Explain whether photos are processed on-device or in the cloud and disclose applicable telemetry. Do not represent cloud processing as exclusively local.
5. Content, outputs and intellectual property
As between you and Finegrain, you retain your rights in your inputs and outputs, subject to third-party rights and applicable law. You may use outputs personally or commercially. Finegrain does not claim ownership of your photos, warrant that every output attracts intellectual-property protection, or guarantee that outputs are unique.
You grant Finegrain only the rights needed to receive, process, temporarily store and return content to provide the requested service, and to investigate content you choose to report. This does not authorize model training. Finegrain does not use your inputs or outputs for training or fine-tuning its models.
You must obtain Finegrain’s prior written permission before using outputs as training data for an AI model. Finegrain software, models, documentation, branding and other proprietary materials remain ours or our licensors’. Rights that cannot lawfully be restricted remain unaffected.
Transformations can alter details or introduce errors. Check results before publishing or relying on them, especially for documents, product listings or uses requiring accurate representation. Examples illustrate possible results, not guarantees.
6. Privacy, retention and reports
The Privacy policy explains account data, SDK telemetry, providers, locations and your rights. Cloud input photos are retained for no more than three days after processing, for debugging only, then deleted. The web app follows the same rule because it uses the API.
Human quality review concerns only photos or other material you choose to report or share through the mobile app, web app, email or customer-support Slack channels. Reported copies are retained separately for the time needed to resolve the issue and assess its quality outcome, as described in the Privacy policy. They are not used for model training. Sharing a report does not transfer ownership of its content.
7. Responsible use and confidentiality
Process only content you are entitled to use and respect privacy, image rights and intellectual property. Do not use the services for unlawful activity, infringement, deceptive or harmful content, security attacks, unauthorized access, or interference with other users. Do not bypass technical restrictions or usage allowances.
Each party must protect the other’s non-public information received in connection with the services, use it only for the relationship and disclose it only to recipients who need it and are bound by appropriate confidentiality duties, or where law requires. This excludes information independently developed, lawfully received without restriction or already public without breach. These duties continue for two years after the relationship ends; personal data and trade secrets remain protected for as long as applicable law requires.
8. Paid services
Prices, billing frequency, usage allowances, taxes and any overage charges are specified in the offer or order you accept. Where a recurring subscription is offered, it renews on the disclosed billing cycle until cancelled under that offer. Unless stated otherwise, cancellation takes effect at the end of the paid period. No refund restriction overrides a statutory refund or withdrawal right. Price changes are notified in advance and do not retrospectively change an already paid period.
You must pay undisputed amounts when due. We may suspend paid access for overdue payment after reasonable notice and an opportunity to resolve it, except where immediate action is justified by fraud or security concerns.
9. Changes, suspension and termination
We may update services and these terms. We will give appropriate notice of material changes and seek additional acceptance where required. Changes do not remove accrued rights. You may stop using the services or cancel according to your plan.
We may suspend or terminate access for a material breach, unlawful use, serious security risk or non-payment. Where reasonable, we will notify you and allow an opportunity to remedy the issue. We may discontinue a service with reasonable notice, subject to contractual and statutory obligations.
On termination, stop using the SDK and API and remove licensed components from future distributions unless a separate agreement permits continued distribution. End users’ lawful use of previously distributed applications is subject to the applicable license and any security-related restrictions. Rights in outputs lawfully created during the relationship survive termination. Content deletion follows the applicable retention rules; legal, confidentiality and payment obligations that by their nature survive continue to apply.
10. Liability
Each party is responsible for its obligations under applicable law. Nothing excludes liability that cannot lawfully be excluded, including mandatory consumer protections and statutory guarantees.
For business customers, to the extent permitted by law, Finegrain is liable only for direct, foreseeable loss caused by its breach, and its aggregate liability under the agreement is limited to the fees paid for the affected services during the twelve months preceding the event giving rise to the claim. This business limitation does not apply where prohibited by law or in cases of fraud or gross negligence. An individually negotiated agreement may set different limits.
11. Data-processing terms for business customers
These provisions apply when Finegrain processes personal data on your behalf through the cloud API or web app. You are the controller, or a processor authorized by the controller, and Finegrain is your processor or subprocessor. You determine lawful purposes and means and remain responsible for required notices, legal bases and instructions. Each party complies with its obligations under applicable data-protection law, including the GDPR.
Scope and instructions. Processing consists of receiving, transforming, temporarily storing and returning input photos and outputs, with associated request data, to perform the services for the duration of your use and applicable deletion periods. Data subjects may include your users and people identifiable in submitted photos or documents. Data categories depend on submitted content and may include images, identifiers and other information visible in them. Avoid submitting sensitive data unless necessary, lawful and supported by appropriate safeguards. These terms, your requests and applicable orders constitute documented instructions. Finegrain processes data only on those instructions, including for transfers, unless law requires otherwise; in that case it will inform you unless legally prohibited. Finegrain will inform you if it considers an instruction infringes applicable data-protection law.
Purpose limitation and confidentiality. Finegrain does not use customer inputs or outputs for its own model training, fine-tuning or unrelated purposes. Personnel authorized to process personal data are subject to confidentiality duties and access is limited to their responsibilities. Human quality review is restricted to material submitted through reporting or support channels.
Security and incidents. Finegrain implements technical and organizational measures appropriate to the risks under Article 32 GDPR, considering the nature and scope of processing. Finegrain will notify you without undue delay after becoming aware of a personal-data breach affecting your data and provide available information and reasonable cooperation to help you meet notification obligations. Information may be provided in stages as it becomes available.
Subprocessors and transfers. You authorize the operational providers described in the Privacy policy to the extent involved in processing your data. Finegrain imposes corresponding data-protection obligations on subprocessors and remains responsible for their performance under applicable law. It will give at least thirty days’ advance notice of intended additions or replacements of subprocessors so you may object on reasonable data-protection grounds. The parties will seek a practical resolution; if none is available, you may terminate the affected service before the change takes effect. Transfers outside the EEA must use a lawful transfer mechanism; these terms alone do not replace any standard contractual clauses required for a particular transfer.
Assistance and accountability. Taking account of the processing and information available, Finegrain will reasonably assist with data-subject requests, security obligations, breach notifications, impact assessments and prior consultations. Finegrain will make available information necessary to demonstrate compliance and permit reasonable audits or inspections by you or an independent auditor bound by confidentiality, subject to arrangements that protect security and other customers’ information without frustrating your statutory rights.
Deletion and return. API inputs are deleted within three days after processing. Outputs are returned through the service. When services end, Finegrain will, at your choice, delete or return remaining personal data processed on your behalf and delete existing copies unless law requires retention. Copies submitted in support reports follow the report-retention purpose and your lawful instructions. Shorter routine deletion periods continue to apply during the relationship.
These data-processing provisions prevail over inconsistent general terms on their subject matter, unless replaced by an individually agreed data-processing agreement.
12. Governing law and disputes
French law governs these terms. Consumers retain mandatory protections under the law of their habitual residence and access to courts competent under applicable law. For disputes between commercial businesses, the courts of Evry have exclusive jurisdiction to the extent permitted by law. Contact hello@finegrain.ai so we can first try to resolve an issue amicably. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
